The office of A Bankruptcy Lawyer Andy Miofsky is open 9-5 Monday through Friday.  Saturday hours are available at the Mt. Vernon office.  I am glad to offer you extended hours for an appointment to meet your needs.  Please call 618/931-1313 to schedule an appointment to review your bankruptcy options.   Your call will be answered 24 hours a day by either a bankruptcy attorney, a scheduler or an automated messaging system.


Chapter 7 Fee (Non-Business):  $901 attorney fee plus $299 filing fee and $50 credit counseling fee = $1250.  Yes, this fee must be paid before the case can be filed.  If you pay in full at the first Bankruptcy Intake meeting and you have all your documents, I can usually get your case filed within a week. 

If you need time payments, you may pay $600 to start the Bankruptcy Intake interview process with the remaining balance paid over time. 

Upon payment of the first $600 I will give you, absolutely free, the exclusive Andy Miofsky's Bankruptcy Organizer system and reusable Miofsky Law Office tote. This system, designed by me, will help you collect and organize the documents you need to file bankruptcy while you are making payments on the balance of your fees and costs. 

Business cases require an additional $500 fee.


Chapter 13 fees require additional fees due to the length of time and additional work involved in such cases.  These fees are often payable over a longer period of time through the monthly payments you make to the court.  A chapter 13 case may usually be started for an initial $600 payment to my office at the beginning of the Bankruptcy Intake interview.  Additional fees may be required in business, delinquent mortgage and repeat filing cases.  Please call 618/931-1313 for details.


After filing bankruptcy a debtor is required to attend a second counseling session before the Court can discharge your debts.  This course can be done in person, over the phone or on the internet.  There is an additional charge for this session that varies by the method and by the provider.  After you file your case I will give you information to help you sign up for this course.

FIVE [5] EASY Things To Bring To Your Bankruptcy Appointment

1.  Tax returns and W-2 forms for the last 2 years, both federal and state.

2.  Bills for every debt your have, including those you want to keep.

3.  Credit reports, if you have them;

4.  Miscellaneous Deeds, Titles, Lease or Purchase Agreements, Proof of Property [House/Car] Insurance, Child Support/Maintenance Court Orders, Lawsuits.

5.  Pay stubs and income statements showing all income received during the last 7 months by you and your spouse, if you are married.  Self employed and business owners should bring in gross business income and expenses, categorized on a month by month basis.

Please have you $600 file preparation fee when you visit the office - $1250 if you are ready to file a non-business chapter 7 case.  If you need time to pay, I will give you Bankruptcy Organizer to help you collect and sort the required items.

If you are delinquent on a home mortgage payment, you should start saving for the next payment as soon as possible.
